Richmond Landfill’s contamination problem resurfaced in the town of Napanee at this week’s council meeting on Tuesday, May 23, 2023.

Kingstonist

Ian Munro, a long-time member of the Concerned Citizens Committee of Tyendinaga and Environs (CCCTE), made a deputation at the meeting to update Council on the state of the landfill site on Beechwood Road.

Munro made Council aware of an attempt by Waste Management Inc. (WM) to bring the closed landfill into compliance with Ontario laws and regulations. WM has submitted three applications to the Ministry of the Environment, Conservation and Parks (MECP) for approval, said Munro. He wanted Council to understand that, in the expert opinion of the CCCTE’s hydrogeologist, the proposals are “not adequate to protect human health and the local environment” from being exposed to noxious chemicals.

Munro stated that the decisions on these applications are expected to be issued in the coming weeks, and the Town of Greater Napanee Council should be aware of the implications.

There are two main conclusions for Napanee, stated Munro. “First, this landfill should never have been located at this location given the complex groundwater environment, and there should never be an expansion of this facility. Second, the currently proposed ‘solutions’ to the off-site groundwater contamination are untested and potentially very dangerous.”

At the outset of his deputation, Munro said, “I know I have a 10-minute limit [to speak], and I’m happy to live within that. But please understand that what I’m giving you tonight is a ‘Coles’ Notes’ version. There are plenty of resources out there for you to learn more.”

Munro then set the scene by going over the history of the Richmond Landfill site, explaining that the landfill was started in 1950, was expanded dramatically in the 1980s, and was immediately sold to a corporate waste company. Then it was sold in the 1990s to WM, which sought to undertake a massive expansion of the dump.

“That particular proposal was rejected in 2006 because the site was not safe,” Munro explained. “It took the MECP six more years after that to order the landfill to be closed… and it took until 2012 to get it closed.”

In 2012, CCCTE, the Mohawks of the Bay of Quinte, and Napanee Green Lights challenged MECP and WM at an environmental review tribunal to ensure safe long-term monitoring. “This process proved the landfill was contaminating the groundwater, despite years of denials by Waste Management,” noted Munro. Due to the tribunal decision, WM is required to “delineate” the extent of “leachate contamination” and bring the site into compliance with Ontario laws and regulations.

An image from Munro’s presentation to Council shows the landfill site as a grey rectangle at the top of this map. The red area on the map represents the current plume of leachate contaminating the groundwater. Screen captured image.

Munro reported that, in 2022, MECP declared the contamination plume to be “reasonably delineated” — in his opinion, “a very strange selection of words.” The CCCTE does not agree with that conclusion, mostly due to issues related to the privately owned property located to the east of the landfill, he said. “Very little testing is being carried out on that property due to a lack of agreement between Waste Management and [landowners] the Martins… so that’s the basis of our concerns about the delineation.”

Munro presented maps to illustrate the group’s concern. “Waste Management, a year ago, submitted applications to get approval for their latest environmental monitoring plan, the Contaminant Attenuation Zone [represented on the map by a dotted line], and a controversial purge well system to manage the contamination onto the neighbouring Martin property. And, perhaps most controversial of all, they’re seeking approval to pump that contaminated water from the ground and deposit it onto the surface, in the stormwater control ponds, south of the landfill.”

Monro emphasized that “as far as I know, and as far as our expert hydrogeologist knows, this is the first time such a proposal has been considered by Ontario. It’s a very strange approach.”

According to Munro, the proposed hydraulic control system poses major risks. First, he said, there is no guarantee that it will work as Waste Management expects, due to very limited testing. “There’s no evidence yet that it could even work. It has been used in other environments where it’s not a fractured limestone base, with success. But this [landfill site’s fractured limestone base] is a completely different environment.”

An image from Munro’s presentation showed the proposed purge well system. Screen captured image.

Second, he said, it could actually make the situation much worse by causing deep saline water to upwell, drawing contaminated water from further underneath the landfill and bringing it to the surface, thereby increasing groundwater contamination.

Third, pumping contaminated groundwater onto the surface and allowing it to flow into the Beechwood ditch poses danger to those downstream, as it flows into Marysville Creek. Munro called this the “most gobsmacking proposal: [to] take this contaminated water and basically dump it into the creek, indirectly.”

Munro said the CCCTE met with MECP on April 11, 2023, and were advised that approval of these applications is expected by the end of May 2023. “Based on what we know at this point, these applications do not address the significant concerns of our hydrogeologist. There is a potentially serious threat to human health and the environment posed by these proposals. [But] in spite of that, MECP appears to be on the verge of approving these applications.”

Munro surmised that in the best-case scenario, the proposal will lower the exposure to the single property to the east of the landfill, but increase the exposure to many properties to the west and downstream on Callaghan Road and including Tyendinaga Township and Mohawks of the Bay of Quinte.

“In the worst case scenario,” he reiterated, “it will make matters much worse by drawing highly dangerous saline to the surface and spreading it around.”

He left Council with options he said they should consider. The first was to confirm the Town of Greater Napanee’s earlier resolutions declaring Napanee to be an unwilling host for any expanded landfill at this site. Also, assuming the WM applications are in fact approved, the Town could appeal to the Ontario Land Tribunal within 15 days, or partner with concerned citizens and neighbouring communities (Tyendinaga Township and Mohawks of the Bay of Quinte) to file a combined appeal.

After councillors had a chance to clarify their understanding of the presentation, Mayor Terry Richardson thanked Munro, admitting that the landfill situation may have slipped out of the current Council’s sphere of awareness. “I know that most of us weren’t around when this whole process started with Waste Management. So for most of us, even in the last term of Council, we didn’t really experience a lot of it,” he said.

Permits to expand or create new landfills are issued by the Ontario Ministry of the Environment and Climate Change. These laws and regulations are created and maintained by the province. Therefore the position of the provincial politicians is of critical importance.

In preparation for the upcoming Provincial Elections and in collaboration with Chief R. Donald Maracle of the Mohawks of the Bay of Quinte we asked our local candidates to respond to a questionnaire about the Richmond Landfill. We are pleased to report that candidates from all parties expressed their support for prohibiting a new or expanded landfill on the site of the Richmond Landfill. They also committed to work toward passing legislation to site mega-landfills on the safest and most suitable locations. The book has received unprecedented praise:

“Fighting Dirty is a primer for citizens’ groups battling against powerful corporations attempting to override sensible environmental planning. But more than that it tells the story of a community of rural agricultural an indigenous peoples pulled together by a need to protect the land they love. It’s well worth a read” - Gord Miller, ecologist former Environmental Commissioner of Ontario

“Fighting Dirty is an inspiring read for all activists battling against the money and power of corporations. It joins Charlie Angus’s book, Unlikely Radicals, in showing that when small group of determined committd citizens don’t give up, leaders and unexpected opportunity will emerge. When a cause is just, good people win.” - David Suzuki, co-founder, The David Suzuki Foundation

“What emerges from the author’s account of the ensuing fight with the company – and sadly the Ontario Ministry of the Environment – is the importance of individuals in any such effort, and also of sheer persistence and bloody-minded refusal to accept being steamrolled by bureaucracy and alleged expertise. She has written a vivid and almost novelsitic account of the principals involved, bringing their struggle to life as part of the tapestry of rural southern Ontario. If an account of an environmental battle can be a page turner, this is it.” Frank Bayerl, Monitor, Canadian Centre for Policy Alternatives Sept / Oct 2017

Fighting Dirty tells the story of how one small group of farmers, small-town residents, and Indigenous people fought the world’s largest waste disposal company to stop them from expanding a local dumpsite into a massive land fill. As one of the experts brought in to assess the impact the toxic waste would have on the community, Poh-Gek Forkert was part of the adventures and misadventures of their decades-long fight. The book will be released in September.

Mr Ruland has been retained by the Concerned Citizens (CCCTE) to review the work of Waste Management (WMCC) and their consultants as they attempt to find the boundary of the contamination leaking from the now closed landfill.
He states “The recent Environmental Review Tribunal (ERT) Hearing and the ERT’s December 24 Decision marked a chance for its consultants to turn over a new leaf – to put the environment and public health and safety first, and to work with the other parties to finally properly delineate the massive off-site groundwater contamination plume emanating from the Richmond Landfill. The environmental catastrophe which the Richmond Landfill represents is entirely the responsibility of WMCC and its consultants, and it is high time for them to be taking a new proactive and protective approach.
But this was not done. Instead, the SCM and CAZ Update Report and the Addendum Report which I reviewed simply represent a continuation of the same failed approach which has been taken for almost 20 years by WM and its consultants.
At this point I can summarize the current state of affairs as follows:
• The eastern margins of the plume have not been delineated, including the extent of an area of urgent concern – the contamination on the adjacent privately owned (Martin) property north of Beechwood Road. An eastward expansion of the CAZ onto the Martin property is necessary but has not been proposed by WMCC.
• The downgradient extent of the plume has not been delineated, and the recently confirmed contamination of a whole new aquifer off-site has not been investigated or addressed.
• The western margins of the plume have not been delineated, including a newly discovered area of shallow groundwater contamination on the west side of the landfill.. ”

Wednesday, January 6, 2016.

An Environmental Review Tribunal has ordered improvements on the Richmond Landfill in Greater Napanee be imposed.
In the lengthy decision, the Environmental Review Tribunal (ERT) has ordered the Ministry of the Environment and Climate Change (MOECC) to impose significant improvements to Waste Management’s Environmental Monitoring Plan (EMP) for the now-closed Richmond Landfill.
Following days of testimony and evidence in the spring of 2015, the ERT released a decision on Dec. 24 outlining its findings and recommendations.
The tribunal process was initiated by an appeal filed in 2012 by the Concerned Citizens group. In the spring and summer of 2015, the tribunal held weeks of public hearings which enabled the parties (Concerned Citizens, Mohawks of the Bay of Quinte, Napanee Green Lights, WM and MOECC) to present factual, technical and scientific evidence regarding the Richmond Landfill and its off-site impacts.
The ERT found the landfill is contaminating groundwater beyond the boundary of the landfill and private, domestic wells have been contaminated. Waste Management will continue to provide alternative water supplies to the affected residences if occupied.
According to the ERT, the hydrogeological complexity of the site makes groundwater monitoring extremely difficult and the chemical 1,4-dioxane is the best indicator of leachate impacts for this site.
“The conclusions were that we’ve been right all along,” said Concerned Citizens chairman Ian Munro Wednesday afternoon. “I wonder where we’d be if we hadn’t been nipping at everyone’s heels all these years.”
The review document states there is evidence of leachate-contaminated groundwater in certain monitoring wells to the north and northwest of the landfill footprint and to the south and southeast of the landfill footprint extending to south of Beechwood Road. There is evidence that suggests an emerging concern there may be contaminated groundwater to the east of the site, north of Beechwood Road.
Further, contingency action is needed to bring the site into compliance with regulatory requirements; and a strict 1µg/l limit for 1,4-dioxane shall be used to determine how far off-site the leachate plume has spread.
The fight against the landfill has been ongoing for years and has taken huge amounts of work, effort and money by community members. “We’d probably have a much, much, much bigger landfill out there that would have been approved years ago. That was rejected in large measure because of our efforts,” said Munro.
He said without the efforts of concerned citizens and other groups involved, the current tribunal would have never happened.
“All the information that has come out as a result of that being made public shows that this landfill has been totally, incompetently monitored for many years.
“What we’ve learned now should have been known 20 years ago or 15 years ago at the minimum and we’re only just getting there now. It’s appalling. It’s taken all this effort on the part of the public and the local community to get the company and the ministry to do the job they should have done years ago.”
Munro first got involved with the group in 2003 and said these processes have been “absolutely time frustrating, time consuming and expensive.”
It is estimated the group has spent at least $200,000 since the late 1990s on fighting the expansions at the Richmond Landfill.
But there’s more work to do. In this tribunal, there is one step to be completed. He said the tribunal has directed all involved parties to provide agreed-upon wording for the implementation of the environmental compliance approval.
“It has to be formalized in writing and put into the licence, basically.”
That step should happen in the month or two, he said.
Apart from the current threat of the existing landfill, Munro said another proposal by Waste Management “to put, basically, four more of those landfills right beside it” is “looming” above the communities.
“That proposal is still on the books. We think this process has demonstrated that they cannot monitor this site adequately, so, what are they thinking?”
That proposal, for the “Beechwood Road Environmental Centre” was initially introduced around 2010 and the terms of reference for that project were ultimately approved in 2012.
Information regarding the project, on the Ministry of Environment website, states the proposed undertaking includes a new secure engineered landfill on a new footprint located north or northeast of the current Richmond Landfill. The new landfill is one component of the proposed Beechwood Road Environmental Centre, which is an integrated waste management facility comprising residential diversion, materials recycling, organics processing, construction and demolition and electronic waste handling facilities. The new landfill footprint is expected to have a total capacity of about 13 million cubic metres. It will include a liner system, leachate collection and landfill gas collection systems.
“It’s just a looming threat that’s sitting there, we’re well aware it’s potentially coming,” he said. “It’s ridiculous and totally irresponsible.”
Mike Bossio, MP for the Hastings, Lennonx and Addington riding, said he was gratified the tribunal has recognized the challenges of the site.
He served as the chairman of the group for several years but stepped back once elected as MP last year.
“All of this stuff could have been done a long time ago, if Waste Management and Ministry of Environment were doing their job.
“I’m gratified, and I’m hopeful that we are going to finally get to the bottom of this and determine the full extent of the contamination and the monitoring plan will finally have some teeth in it.”
Both Bossio and Munro lauded the efforts of the citizens’ group, the Mohawks of the Bay of Quinte and the Napanee Green Lights group.
“I am just so proud of the Concerned Citizens group and the incredible work they have done. It really is a sad state when we have to rely on a small community organization to fund a fight like this and let alone fight the fight in the first place,” Bossio said. “This really was unnecessary. If the company and MOE were doing their jobs we wouldn’t have to do it for them.”
Bossio, too, is concerned about the Beechwood Road Environmental Centre and said the site is unsuitable for a landfill.
“One of the most unsuitable sites for a landfill in all of Ontario, so put an end to it. There’s no reason that our community should have to go through this.”
Chief Don Maracle of the Mohawks of the Bay of Quinte made a similar statement, saying, “We are very pleased with some of the outcomes of the hearing, but very disturbed at the financial burden on our community and others. We hope the environmental protection will continue, but that the cost will ultimately be borne by the company responsible for these problems, Waste Management.”
Other key findings of the ERT include the former Lewis Meats abattoir is not a significant source of contaminants in groundwater, contrary to WM assertions; the full geographic extent of the leachate plume has not been fully delineated by WM despite extensive fieldwork; the farm property southeast of the landfill requires further investigation for groundwater impacts; testing of private wells every two years along Belleville Road is ordered; a study into the potential impact of existing and proposed pipelines south of the landfill has been ordered; and use of a blast trench as a contingency option has been eliminated from the EMP.

The ERT has also ordered a much stricter leachate detection regime. Full text of the decision is available at ERT Decision Dec 24 2015

The Tribunal process was initiated by an appeal filed in 2012 by the Concerned Citizens.

In its decision, the ERT allowed the Concerned Citizens’ appeal and found that:

• The hydrogeological complexity of the site makes groundwater monitoring extremely difficult;
• The chemical 1,4-dioxane is the best indicator of leachate impacts for this site;
• The landfill is contaminating groundwater beyond the landfill boundary;
• Private domestic wells have been contaminated, and WM shall continue to provide alternative water supplies to the affected residences if occupied;
• Leachate contamination of groundwater extends hundreds of meters from the landfill footprint, and currently underlies public and private properties south of the landfill;
• Contingency action is needed to bring the site into compliance with regulatory requirements; and
• A strict 1µg/l limit for 1,4-dioxane shall be used to determine how far off-site the leachate plume has spread.

Other key findings include: the former Lewis Meats abattoir is not a significant source of contaminants in groundwater, contrary to WM assertions; the full geographic extent of the leachate plume has not been fully delineated by WM despite extensive fieldwork; the farm property southeast of the landfill requires further investigation for groundwater impacts; testing of private wells every two years along Belleville Road is ordered; a study into the potential impact of existing and proposed pipelines south of the landfill has been ordered; and use of a blast trench as a contingency option has been eliminated from the EMP.

Ian Munro, Chairman of the Concerned Citizens, said: “While this decision effectively supports every important recommendation we have made, it is regrettable that a group of citizens must organize and fund this work to protect our local environment. Over the years, our citizens’ group has been forced to raise and expend significant funds pursuing our concerns because, in our opinion, both WM and the MOECC unjustifiably rejected recommendations made by the Concerned Citizens and their experts. I am gratified that these recommendations have now been imposed by the ERT in a legally binding decision at the conclusion of this appeal process. Concerned Citizens would like to thank our team of experts including Wilf Ruland (hydrogeology) and Dr. Poh-Gek Forkert (toxicology), our CELA lawyer Richard Lindgren, our tireless volunteers and all who have supported us in these efforts over many years.

Concerned Citizens’ hydrogeologist Wilf Ruland indicated that the ERT decision confirmed that WM was responsible for the massive off-site contamination caused by the Richmond Landfill, and for the very challenging task of trying to track the off-site contamination in the complex and highly unpredictable groundwater flow system. Mr. Ruland went on to state that “the job of determining how far off-site the contamination has gone is far from complete, with the actual extent of the leachate plume still unknown.”

“The ERT decision wholly vindicates my client’s long-standing concerns about groundwater contamination emanating from the Richmond Landfill Site,” said Richard Lindgren, lawyer for the Concerned Citizens. “In addition, it is my view that the Tribunal’s findings make it abundantly clear that this fractured bedrock setting is unsuitable for the massive Beechwood Road Environmental Centre (BREC) landfill being proposed by WM beside the Richmond Landfill.”

“The Mohawks of the Bay of Quinte share many of the Concerned Citizens’ concerns”, said Chief Don Maracle. “At the same time, as an independent First Nation government, the cost of these proceedings has had to be taken from funds badly needed for the operation of our community and the well-being of our residents. We are very pleased with some of the outcomes of the hearing, but very disturbed at the financial burden on our community and others. We hope the environmental protection will continue, but that the cost will ultimately be borne by the company responsible for these problems, Waste Management.”

Evidence at the Tribunal confirmed that the old landfill is leaking and contaminating the groundwater beyond the boundaries of the property owned by Waste Management. This order requires more rigorous monitoring and reporting than had been required in the monitoring plan proposed by Waste Management and approved earlier by the MOECC. The order can be read by clicking this link: ERT Ruling July 21, 2015
